NOTICE IS HEREBY GIVEN THAT THE BOARD OF COMMISSIONERS OF LOWER SWATARA TOWNSHIP, DAUPHIN COUNTY, PENNSYLVANIA, WILL HOLD A PUBLIC HEARING ON MONDAY, OCTOBER 16, 2017, AT 7:00 P.M., AT THE LOWER SWATARA FIRE DEPARTMENT LOCATED AT 1350 FULLING MILL ROAD, MIDDLETOWN, PENNSYLVANIA 17057, TO RECEIVE PUBLIC COMMENT ON A PROPOSED AMENDMENT TO THE ZONING ORDINANCE OF LOWER SWATARA TOWNSHIP CODE OF ORDINANCES, CHAPTER 27, ZONING, AS REVISED. SAID AMENDMENT WOULD DEFINE PARCEL DELIVERY DISTRIBUTION FACILITY, AND PERMIT THAT NEW USE IN THE MINERAL RECOVERY DISTRICT, SUBJECT TO CERTAIN SPECIFIC USE CRITERIA. THE AMENDMENT WOULD ALSO REZONE AND CHANGE PORTIONS OF TAX PARCEL NOS. 36-003-009 AND 36-006-001 FROM CONSERVATION TO MINERAL RECOVERY, AND REZONE AND CHANGE A PORTION OF TAX PARCEL 36-003-009 FROM MINERAL RECOVERY TO CONSERVATION. FURTHERMORE, THE BOARD OF COMMISSIONERS WILL CONSIDER SAID ZONING AMENDMENT FOR ADOPTION AT THEIR REGULARLY SCHEDULED MEETING TO BE HELD AT 7:00 P.M. ON WEDNESDAY, OCTOBER 18, 2017, AT THE TOWNSHIP BUILDING LOCATED AT 1499 SPRING GARDEN DRIVE, MIDDLETOWN, PENNSYLVANIA 17057. THE TITLE OF THE PROPOSED ORDINANCE AND A BRIEF DESCRIPTION ARE AS FOLLOWS:
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE TOWNSHIP OF LOWER SWATARA, DAUPHIN COUNTY, PENNSYLVANIA, NO. 448, AS AMENDED AND SUPPLEMENTED, CHAPTER 27, ZONING TO DEFINE AND PERMIT PARCEL DELIVERY DISTRIBUTION FACILITIES IN A CERTAIN ZONING DISTRICT, SUBJECT TO SPECIFIC USE CRITERIA, AND TO REZONE A PORTION OF THE PROPERTIES IDENTIFIED AS TAX PARCEL NOS. 36-003-009 AND 36-006-001.
SECTION 1 of said ordinance would amend the Zoning Ordinance of the Township of Lower Swatara, Part 3, Section 27-302, to rezone and change a portion of Tax Parcel No. 36-003-009 and a portion of Tax Parcel 36-006-001 from the Conservation District to the Mineral Recovery District.
SECTION 2 of said ordinance would amend the Zoning Ordinance of the Township of Lower Swatara, Part 3, Section 27-302, to rezone and change a portion of Tax Parcel 36-003-009 from Mineral Recovery District to the Conservation District.
SECTION 3 of said ordinance would amend the Zoning Ordinance of the Township of Lower Swatara, Part 2, Section 203 to add and define Parcel Delivery Distribution Facility as a defined term.
SECTION 4 of said ordinance would amend the Zoning Ordinance of the Township of Lower Swatara, Part 16, Section 1602, to add a new subsection L permitting Parcel Delivery Distribution Facilities in the Mineral Recovery District: M-R, and to renumber the current subsection L as subsection M.
SECTION5 of said ordinance would amend the Zoning Ordinance of the Township of Lower Swatara, Part 16, Section 1607, to amend the maximum total lot coverage applicable in the Mineral Recovery District: M-R to 60% of the lot area.
SECTION 6 of said ordinance would amend the Zoning Ordinance of the Township of Lower Swatara, Part 20, Section 27-2002, to add subsection 30, Parcel Delivery Distribution Facilities, containing specific use criteria applicable to Parcel Delivery Distribution Facility uses where said use is permitted.
SECTION 7 of said ordinance provides that the provisions of the ordinance are severable and that if any section, sentence, clause, part or provision thereof were held to be illegal, invalid or unconstitutional, such decision should not affect or impair the remaining sections, sentences, clauses, parts or provisions of this ordinance.
SECTION8 of said ordinance holds that all other parts, provisions and sections of the Code of Ordinances of the Township of Lower Swatara shall remain in full force and effect.
SECTION 9 of said ordinance provides that the ordinance shall become effective immediately upon its enactment by the Board of Commissioners of Lower Swatara Township.
